1. Parties & Independent Contractor Status
This Affiliate Agreement ('Agreement') is entered into by and between English Measure ('Platform') and the independent publisher/partner applying to or participating in the Affiliate Program ('Affiliate'). The Affiliate is an independent contractor and not an employee, agent, joint venturer, or legal representative of the Platform.
2. Application, Registration & Tracking System
Upon approval, each Affiliate is automatically assigned a unique referral link (e.g., https://englishmeasure.com/?ref=REF-XXXXX). Visitors who click this link are tagged with a 30-day cookie, and their subsequent eligible Premium subscription purchases are attributed to the Affiliate (via their referredBy code).
3. Commission Rates (33%) & Qualifying Sales
The Affiliate earns a 33% commission on verified, real payments made through their referral link:
- 🔹 1-Month Subscription: 33% of the $3.49 package price, i.e. $1.15, is credited as commission on every real payment event (initial sale + renewals).
- 🔹 3-Month Subscription: 33% of the $7.99 package price, i.e. $2.64, is credited as commission on every purchase.
- 🔹 12-Month (Annual) Subscription: 33% of the $29.99 package price, i.e. $9.90, is credited as commission on every purchase.
4. Payment Process, Minimum Threshold & Manual Payout to Your Wise Account
Payouts are sent manually only to the Wise account registered by the Affiliate.
- 💵 Minimum Payout Threshold: A minimum payable balance of $50 USD is required to initiate a payout request.
- ⚡ Payout Requests: Requests may be submitted daily; the admin verifies the Wise account details and sends the payment within 1-2 business days.
- 💳 Required Information: You must provide the email address of your Wise account and the account holder name. You can easily transfer the payment from your Wise account to your own local bank account.
- ⚖️ Taxation & Compliance: The Affiliate is solely responsible for their tax obligations in their own country.
5. Marketing Restrictions & Brand Bidding Prohibition
Affiliates must conduct all marketing efforts professionally, ethically, and in full compliance with law.
- ✅ Allowed Practices: Promotion via personal or business social media channels, websites, blogs, and opt-in email newsletters is allowed.
- 🚫 Brand Bidding Prohibition: Bidding on 'English Measure', 'EMA', or any trademarked brand terms on search engines (Google Ads, Bing Ads, Meta Ads) is STRICTLY PROHIBITED.
- 🛑 Anti-Spam Policy: Unsolicited bulk commercial email (SPAM), deceptive statements, or misleading discount offers are strictly banned.
6. Refunds, Chargebacks & Fraud Prevention
Commissions are only earned from real, webhook-verified payments. Fake premium users (e.g., mock local premium flags) generate no commission. Refunds or chargebacks cancel the related commission. Self-referrals are prohibited.
7. Termination & Account Suspension
Either party may terminate this Agreement at any time. However, any breach of brand bidding rules, anti-spam policies, or fraudulent activity will result in immediate account termination and forfeiture of unpaid earnings.
8. Amendments & Governing Law
The Platform reserves the right to amend these terms at any time. Continued participation in the Affiliate Program constitutes acceptance of modified terms.
